About This Case:

Michael John Burch, a 69-year-old retired correctional officer, suffered brutal mistreatment and neglect while in custody at the Huerfano County Detention Center. Mr. Burch entered the jail on March 25, 2023, in the midst of a mental health crisis but with no physical injuries. Three days later, he was violently assaulted by Detention Officer Stuart Pino, suffering six broken ribs, punctured organs, and massive internal bleeding. Despite his pleas for medical care, officers and medical staff ignored his suffering. His condition deteriorated over the following days as he endured excruciating pain, his right lung collapsing as his body struggled to cope with his injuries. On the night of April 3, 2023, he prepared for his final moments, lying on the floor of his cell. He was pronounced dead in the early morning hours of April 4, 2023.

This case highlights the inhumane treatment Mr. Burch endured and the complete failure of those responsible for his well-being. His cries for help went unanswered as his body succumbed to injuries that were entirely preventable with timely medical intervention. The jail staff took deliberate steps to conceal his suffering, including covering his cell window to avoid witnessing his pain. Had he received even the most basic medical attention, his life could have been saved. Instead, he spent his final days in agony, abandoned by those entrusted with his care.

The details of Mr. Burch’s death serve as a stark reminder of the systemic issues within detention centers, where neglect and abuse too often go unchecked. His case raises serious concerns about the treatment of vulnerable individuals in custody, particularly those experiencing mental health crises. It underscores the urgent need for reform in how law enforcement and medical personnel respond to detainees in distress, ensuring that no one else endures the same fate.
