About This Case:

Our firm represents Drake Solomon in a lawsuit against Kroenke Sports & Entertainment (KSE), the parent company of the Denver Nuggets, for unlawful disability discrimination and retaliation. Mr. Solomon served as the team’s beloved mascot “Rocky,” a role that had previously been filled by his father who had originated the character. After performing successfully in the role beginning in 2021, Mr. Solomon was diagnosed with a serious hip condition during the 2022-23 NBA season and underwent surgery. Despite his dedication, returning to work within ten days of surgery and later undergoing a total hip replacement, he was met with hostility and ultimately fired in August 2024. His termination came shortly after tryouts were held specifically due to his medical history, despite his clean bill of health and ability to perform the physical demands of the role. These actions violated Mr. Solomon’s rights under the Colorado Anti-Discrimination Act (CADA).

In addition to his on-court performances, Drake proudly represented the Denver Nuggets as Rocky through a wide range of community and charitable efforts. His goal with each appearance was simple: to leave people smiling, inspired, and proud to be part of the Denver Nuggets community. He supported youth basketball programs with the Gold Crown Foundation, brought holiday cheer through toy drives with Rocky Mountain Hospital for Children, and helped collect sports equipment for young athletes in need. He honored educators with monthly classroom visits as part of the Most Valuable Teacher Awards and even rappelled down a 45-story building to raise awareness for cancer research. His involvement extended to the Special Olympics, Make-A-Wish experiences, visits to Children’s Hospital, and outreach to veterans in hospitals and rehab centers.

In addition to the discriminatory termination, KSE presented Mr. Solomon with a severance agreement that violated multiple provisions of Colorado’s Protecting Opportunities and Workers’ Rights Act (POWR Act). This case highlights the importance of protecting workers from discriminatory practices, particularly when they face health challenges and seek fair treatment upon returning to the workplace.
